The Ministry of Justice explained effective ways to challenge administrative decisions.


The Ministry of Justice provided an explanation regarding the possibility of challenging decisions made by administrative authorities.
According to the department's data, decisions made by administrative authorities do not always satisfy the interests of the individual, which creates a need for them to be challenged through administrative or judicial procedures.
Administrative appeal is the submission of a complaint to a higher-ranking official or a higher administrative body. This method of appeal is more economical and faster than judicial appeal. It does not require deep legal knowledge or the assistance of a lawyer. The main advantage of administrative appeal is that a desired result can be achieved faster and without additional costs. Moreover, this method allows the administrative body to easily correct its mistake.
An individual has the right to administrative appeal if their rights, freedoms, or legal interests have been violated by an administrative act or its execution, or if the actions of the administrative body negatively affect their rights, freedoms, or interests.
The subject reviewing the complaint may be a higher-level administrative body or a central governmental authority that has delegated powers to local self-governing bodies.
The complaint must be submitted within 30 calendar days from the day the act was brought to the attention of the individual. In case of missing the deadline for valid reasons, a request for its renewal can be submitted.
After reviewing the case, the subject considering the complaint may cancel the administrative act, adopt a new act, leave the complaint unresolved, or require the administrative body to correct the negative consequences.
If a decision on the complaint is not provided within the established Time frame, the complaint will be considered satisfied.
